Skoul Terms of Use

Introduction

Welcome to Skoul! These Terms of Use ("Terms") govern your access to and use of the Skoul mobile application for iPhone, iPad and Android ("App"), an educational platform designed specifically for children aged 6-12. By downloading, installing, or using the App, you agree to be bound by these Terms.

IMPORTANT: Skoul is intended for children aged 6-12 years old. If your child is under the applicable age of digital consent (13 in the United States, 15 in France and Spain, or other thresholds in the EU), you as a parent or legal guardian must review and accept these Terms on behalf of your child.

1. Acceptance of Terms

1.1 Agreement to Terms

By using Skoul, you agree to:

  • These Terms of Use
  • Our Privacy Policy (available at https://skoul.fr/privacy and in the App)
  • All applicable laws and regulations governing children's online privacy

1.2 Parental Consent

If your child is:

  • Under 13 (United States under COPPA)
  • Under 15 (France and Spain under GDPR)
  • Under 16 (Other EU countries under GDPR)
  • Under 13 (Other countries, as a conservative default)

You, as a parent or legal guardian, must provide consent and supervise your child's use of the App. By completing the onboarding process and checking the consent checkbox, you confirm that:

  • You are the parent or legal guardian of the child using the App
  • You have read and understood these Terms and our Privacy Policy
  • You consent to the collection and use of your child's information as described in our Privacy Policy
  • You understand that all data is stored locally on your device

1.3 Age Restrictions

Skoul is designed exclusively for children aged 6-12 years old. Users outside this age range should not use the App. We reserve the right to verify ages and enforce these restrictions.

1.4 Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App, or by email if you gave us one for the Sunday report. Continued use of the App after changes constitutes acceptance of the updated Terms.


2. Description of Service

2.1 Educational Services

Skoul is a homework coach for children aged 6-12, in English, French, Spanish and German. It provides:

Today's page: a short daily plan of maths, reading and writing.

Maths notebook:

  • Numbers, operations, times tables, fractions and measures, generated on the device (no internet needed)
  • With Skoul+: time, money, distances and word problems
  • Exercises adapted to the child's age

Reading notebook:

  • Syllables, words, pictures, texts and a one-minute read with on-device speech recognition (nothing is recorded or sent)
  • AI reading texts on request

Writing notebook:

  • Tracing, dictation, speed typing and speed writing
  • Custom word lists typed in, read from a photo or a file (recognised on the device), or written by AI

Mistake box:

  • Wrong answers come back after 1, 3, 7, 14 and 30 days until mastered
  • Stored on the device only

Homework help (Skoul+):

  • The child photographs a school exercise; the App sends the photo to our API for AI analysis
  • Explain (hints one at a time), check (marks what the child wrote), the lesson, and a quiz on the same idea
  • Wrong answers can be added to the mistake box

Parents area: reports, reminders, privacy settings and data export, protected by a grown-up check (Face ID, Touch ID, fingerprint, the device passcode or a Skoul parent PIN). With Skoul+: a Sunday report by email and a parent PIN.

2.2 Personalization Features

  • User profiles with first name, age, and country
  • Optional avatar customization (stored locally only)
  • Difficulty adaptation based on performance
  • Progress tracking and session history (stored locally only)

2.3 Exercise Generation and Homework Analysis

Maths drills, the mistake box and most reading and writing drills are generated entirely on your device. For AI practice and homework help, Skoul works as follows:

  1. Skoul API (Cloudflare):
    • Receives only non-nominative data: age, country, language, difficulty, subject and, for homework help, the photo of the exercise
    • Asks OpenAI to write the practice or read the photo, with Anthropic (Claude) and then Groq as backups (each is asked only if the previous one fails)
    • Does not keep the photo or the content of the request
    • Generated content is returned and stored on your device
  2. Android only - Google Gemini directly (Firebase AI Logic):
    • Used for maths word problems and AI word lists when the Skoul API cannot be reached
    • Same non-nominative data; never homework photos
    • Subject to Google's Gemini API Terms: https://ai.google.dev/gemini-api/terms
  3. Bundled content: if no AI is reachable, the App falls back to exercises included in the App.

Quotas: The free version includes 7 AI practices and 5 homework exercises in total (lifetime, shared across the App). Skoul+ removes these limits.

2.4 Skoul+ Subscription

Skoul+ is an optional auto-renewing subscription that unlocks:

  • Unlimited homework help
  • Unlimited AI practice
  • Advanced maths (time, money, distances, word problems)
  • The Sunday report and a parent PIN

Price: €4.99 per month or €29.99 per year. Local prices may vary and are shown in the App Store or Google Play before purchase. Prices may change; any change will be announced with notice through the store and will apply from the next renewal.

Free trial: The yearly plan includes a 7-day free trial for new subscribers; the monthly plan has no trial. The trial converts automatically into a paid subscription unless it is cancelled at least 24 hours before the end of the trial period.

Automatic renewal: The subscription renews automatically at the end of each period (monthly or yearly) unless auto-renewal is turned off at least 24 hours before the end of the current period. Payment is charged to your Apple ID or Google account at confirmation of purchase and at each renewal.

Managing or cancelling: You can manage or cancel the subscription at any time in your Apple ID subscriptions (iPhone and iPad) or in Google Play > Payments & subscriptions (Android). Cancelling stops the next renewal; access to Skoul+ continues until the end of the period already paid.

Who may purchase: Purchases must be made by a parent or legal guardian. The App asks for a grown-up check before the purchase screen, and the store may ask for additional confirmation. Skoul+ can be shared with your family where the store allows it.

2.5 Free Version and No Advertising

The core of Skoul is free: maths, reading and writing drills in English, French, Spanish and German, today's page and the mistake box. Skoul+ is optional. Skoul contains no advertising, ever, and does not integrate any advertising SDK.


3. User Responsibilities

3.1 Parental Supervision

Parents and guardians are responsible for:

  • Supervising their child's use of the App
  • Ensuring the device is secure (passcode/biometric lock)
  • Monitoring practice sessions and progress
  • Teaching appropriate online behavior
  • Reviewing and managing data in the Parents area

3.2 Device and Account Security

You are responsible for:

  • Maintaining the security of your device
  • Installing system updates for security patches
  • Preventing unauthorized access to the App
  • Keeping your device passcode or biometric authentication secure

3.3 Accurate Information

You must provide accurate and truthful information during onboarding:

  • Child's first name
  • Age (6-12 years)
  • Country

Providing false information may result in inappropriate content delivery or compliance issues.

3.4 Prohibited Uses

You agree NOT to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Circumvent security features or restrictions
  • Use the App to harm, abuse, or exploit children
  • Extract or scrape content from the App
  • Upload malicious content or viruses
  • Share inappropriate content through the App
  • Violate any applicable laws or regulations
  • Use the App if you are outside the 6-12 age range

4. Privacy and Data Protection

4.1 Local-First Data Storage

Skoul prioritizes your privacy through local-first architecture:

  • All personal data stored locally on your device
  • No user accounts or login credentials required
  • No cloud synchronization of personal information
  • No remote servers storing your child's name, avatar, or practice history (what our servers keep is listed in the Privacy Policy)

4.2 Data We Collect

During onboarding, we collect:

  • First name (stored locally)
  • Age between 6-12 (stored locally)
  • Country (stored locally)
  • Optional avatar photo (stored locally as compressed JPEG)

During practice sessions, we collect locally:

  • Session completion records
  • Accuracy scores and performance metrics
  • Time spent on activities
  • Difficulty progression
  • Session history
  • Mistake review box and skill mastery
  • Homework history (photo and result), erased with Delete everything in the Parents area

4.3 Data We Send for AI Features

ONLY the following non-nominative data is transmitted for AI practice (to our API, or on Android to Google Gemini directly when our API cannot be reached):

  • Age (number only, e.g., "8")
  • Country code (ISO code, e.g., "FR")
  • Language (English, French, Spanish or German)
  • Exercise difficulty
  • Subject

For homework help, the photo of the exercise is also transmitted to our API and read by OpenAI, Anthropic or Groq. It is used only for the explanation, the check, the lesson or the quiz, and is not retained by us after the response. On-device drills send nothing at all.

Every request to our API also carries an app install identifier, the app version and your IP address, kept 30 days in server logs (see the Privacy Policy).

NEVER transmitted:

  • Child's name or class
  • Avatar photo
  • Practice history or session data

4.4 Data Encryption

  • Local data protected by the operating system's encryption
  • Data in transit uses HTTPS (TLS)

4.5 Data Retention and Deletion

  • Local data: Retained until you use Delete everything in the Parents area or delete the App
  • Server retention: server logs 30 days; your email only if you subscribe, until you unsubscribe; no homework photos (details in the Privacy Policy)
  • Immediate deletion: Uninstalling the App permanently removes all local data
  • No recovery: Deleted data cannot be recovered by HIGHTHEM

4.6 Your Rights (GDPR/COPPA)

You have the right to:

  • Access: View your child's progress and reports in the Parents area, and export them
  • Rectification: Edit profile information directly in the App
  • Erasure: Delete practice data or all data by uninstalling
  • Data Portability: Export progress from the Parents area
  • Object: Turn off optional features (homework photos, crash reports, usage statistics, notifications)
  • Complain: Lodge complaints with CNIL (France) or your data protection authority

5. Intellectual Property Rights

5.1 Ownership

All content, features, and functionality of Skoul are owned by HIGHTHEM and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

This includes but is not limited to:

  • App source code and architecture
  • User interface design and graphics
  • Original illustrations and icons
  • Educational content and exercise formats
  • Algorithms and business logic
  • Branding, logos, and trademarks

5.2 License to Use

Subject to your compliance with these Terms, HIGHTHEM grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on devices you own or control
  • Use the App for personal, non-commercial educational purposes
  • Access features and content within the App

5.3 Restrictions

You may NOT:

  • Copy, modify, or create derivative works of the App
  • Sell, rent, lease, sublicense, or transfer the App
  • Remove copyright, trademark, or proprietary notices
  • Use the App or content for commercial purposes
  • Redistribute or republish App content

5.4 User-Generated Content

Content created by users (e.g., custom word lists, avatars) remains on the user's device and is not transmitted to HIGHTHEM servers. You retain ownership of such content but grant HIGHTHEM a limited license to process it locally for App functionality.

5.5 Third-Party Content

The App may display content or links from third parties (e.g., App Store subscription screens). We do not claim ownership of third-party content and are not responsible for its accuracy or appropriateness.


6. Third-Party Services

6.1 AI Providers (OpenAI, Anthropic and Groq)

Skoul's API uses OpenAI, with Anthropic (Claude) and then Groq as backups, to read homework photos and write AI practice; each is asked only if the previous one fails. On Android, the App may also use Google Gemini directly (Firebase AI Logic) when our API cannot be reached:

  • Only non-nominative data and homework photos are transmitted (see Section 4.3)

6.2 Apple App Store and Google Play

Skoul+ subscriptions are sold and processed by Apple (App Store) or Google (Google Play):

  • Billing, trials, renewals and refunds are handled by the store under its own terms
  • We never see your payment details; the App only receives the subscription status
  • Apple's privacy policy: https://www.apple.com/legal/privacy/; Google's privacy policy: https://policies.google.com/privacy

6.3 Other Service Providers

  • Cloudflare hosts our API
  • Resend sends our emails (Sunday report, codes, news)
  • Firebase Crashlytics (Google) receives crash reports, only if a parent turns them on

6.4 No Other Third Parties

Skoul does NOT use:

  • Advertising networks or advertising SDKs
  • Third-party analytics (Firebase Analytics is not included)
  • Social media integrations
  • Data brokers or marketing platforms
  • Cloud storage providers for personal data

6.5 Third-Party Liability

HIGHTHEM is not responsible for the practices, content, or actions of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.


7. Disclaimers and Limitations of Liability

7.1 Educational Purpose

Skoul is designed to supplement, not replace, formal education. The App:

  • Provides practice exercises and activities
  • Is NOT a substitute for qualified teachers or tutors
  • Does not guarantee specific learning outcomes
  • Should be used under parental supervision

7.2 "AS IS" and "AS AVAILABLE" Basis

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content
  • Continuous, uninterrupted, or secure access

7.3 No Guarantee of Results

HIGHTHEM does not guarantee:

  • Specific educational outcomes or improvements
  • Compatibility with all devices
  • Error-free or uninterrupted service
  • Correction of all defects or bugs

7.4 Limitation of Liability

To the maximum extent permitted by law, HIGHTHEM and its officers, directors, employees, and agents shall NOT be liable for:

  • Indirect, incidental, special, consequential, or punitive damages, including but not limited to:
    • Loss of profits or data
    • Loss of use or productivity
    • Business interruption
    • Educational delays or setbacks
  • Direct damages exceeding the amount paid by you for Skoul+ in the twelve months preceding the claim (zero if you use the free version)

7.5 Third-Party Services

HIGHTHEM is not liable for:

  • Actions or inactions of third-party services (OpenAI, Anthropic, Groq, Google, Apple, Cloudflare, Resend)
  • Data practices of third parties
  • Accuracy of AI-generated hints or checks, which the child should confirm with a parent or teacher
  • Interruptions in third-party services

7.6 Device and Data Loss

HIGHTHEM is not responsible for:

  • Loss of device or theft
  • Data loss due to device failure or user error
  • Inability to recover data after App deletion
  • Operating system updates that affect App functionality

7.7 User Actions

HIGHTHEM is not liable for:

  • Misuse of the App by users
  • Unauthorized access due to user negligence
  • Inaccurate information provided by users
  • Failure to supervise children's use

7.8 Jurisdictional Variations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.


8. Termination

8.1 Termination by User

You may terminate your use of Skoul at any time by:

  • Using Delete everything in the Parents area
  • Uninstalling the App from your device

Uninstalling the App immediately and permanently deletes all local data. This action cannot be undone.

8.2 Termination by HIGHTHEM

We reserve the right to:

  • Suspend or terminate access to the App for violations of these Terms
  • Discontinue the App or any features at any time without notice
  • Refuse service to anyone for any lawful reason

8.3 Effect of Termination

Upon termination:

  • Your license to use the App ends immediately
  • You must delete the App and all related content from your devices
  • Sections of these Terms that by nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will remain in effect

8.4 Refunds

Skoul+ subscriptions are sold and billed by Apple or Google. Refunds are handled by the store under its terms: request one at https://reportaproblem.apple.com (Apple) or in Google Play (Google). HIGHTHEM cannot issue refunds directly. Cancelling a subscription does not refund the current period.


9. Compliance with Laws

9.1 COPPA Compliance (United States)

Skoul complies with the Children's Online Privacy Protection Act (COPPA):

  • Parental consent obtained for children under 13
  • Minimal data collection (only what's necessary)
  • No sharing of children's data with third parties for marketing
  • No advertising in the App
  • Parents can review, delete, or refuse further collection of data

9.2 GDPR Compliance (European Union)

Skoul complies with the General Data Protection Regulation (GDPR):

  • Age-gating based on country-specific thresholds (13-16 years)
  • Enhanced data subject rights (access, rectification, erasure, portability, objection)
  • Lawful basis for processing: parental consent and legitimate interest
  • No automated decision-making or profiling
  • Right to lodge complaints with supervisory authorities (CNIL in France)

9.3 International Data Transfers

  • Skoul API (Cloudflare): requests processed in Cloudflare's network under its Data Processing Addendum and the EU Standard Contractual Clauses
  • OpenAI, Anthropic and Groq: data (including homework photos) may be processed in the United States under their data processing terms and the EU Standard Contractual Clauses
  • Google Gemini (Android only): AI practice requests (never homework photos) may be processed in the United States under Google's data processing terms and the EU Standard Contractual Clauses
  • Resend: emails may be processed in the United States under its data processing terms and the EU Standard Contractual Clauses
  • Apple and Google: subscription processing under their own terms

9.4 User Compliance

You agree to comply with all applicable local, national, and international laws and regulations when using the App.


10. Dispute Resolution

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.

10.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or the App shall be filed exclusively in the competent courts of France, and you consent to the jurisdiction of such courts.

10.3 Informal Resolution

Before filing a legal claim, you agree to contact us at privacy@skoul.fr to attempt to resolve the dispute informally. We will make good-faith efforts to resolve disputes amicably.

10.4 Arbitration (If Applicable)

If informal resolution fails, disputes may be subject to binding arbitration in accordance with French arbitration law, unless prohibited by applicable consumer protection laws.

10.5 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.

10.6 Exceptions

Nothing in this section limits your rights under mandatory consumer protection laws in your jurisdiction.


11. Miscellaneous Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HIGHTHEM regarding the use of Skoul and supersede all prior agreements, understandings, or communications.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

11.3 Waiver

The failure of HIGHTHEM to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of HIGHTHEM.

11.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations without HIGHTHEM's prior written consent. HIGHTHEM may assign these Terms without restriction, including to an affiliate or in connection with a merger, acquisition, or sale of assets.

11.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

11.6 Force Majeure

HIGHTHEM shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to:

  • Acts of God (natural disasters, pandemics)
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Internet or telecommunications failures
  • Third-party service outages (AI providers, Apple, Google, Cloudflare)

11.7 Notices

Notices to HIGHTHEM should be sent to: privacy@skoul.fr

Notices to you may be provided through the App, via push notification, or by other reasonable means.

11.8 Language

These Terms are provided in English, French, Spanish and German. In the event of any conflict between translations, the English version shall prevail.

11.9 Survival

Sections that by their nature should survive termination shall survive, including but not limited to: Intellectual Property Rights, Disclaimers and Limitations of Liability, Dispute Resolution, and Miscellaneous Provisions.
